Ubud - Tegenungan Waterfalls – Rice Fields - Local Markets
Rise and shine! Day 2 is where the action starts. Moving from the ocean to the tranquility of the lush hills, our next stop is in Ubud. Enjoy a delightful lunch overlooking the stunning Tegallalang rice terraces. Get the best view of the lush rice terraces on one of the many rope swings around, don’t forget to get your photographer in position for that awesome photo. To end the day we will be taking a breathtaking walk to the towering Tegenungan waterfalls. You will be grateful for the chance to refresh under the cool water of the falls. We end the day by visiting the local markets and getting those essential Bali souvenirs and gifts, don’t forget to haggle!
Ubud, Monkey Forest - Cooking Class
After your delicious breakfast, we will head to the famous Monkey Forest, keep a tight grip on your belongings as the monkeys can be incredibly cheeky! In the early afternoon, we fire up the woks under the watchful eye of our traditional Balinese chefs. Nothing is more satisfying or tasty than this self-cooked spread which you enjoy as a group on completion.
Ubud, Climb Mt Batur
Mount Batur hike I hear you say! For the keen hikers, the early start is one hundred percent worth it when watching the sun shimmer through the clouds at the summit of Mount Batur. Enjoy a hot cup of sweet tea or coffee whilst taking the time to absorb the sun climbing through the clouds below. For those less inclined to adorn activewear before sunrise, you are ensured a restful night's sleep in our beautiful Ubud hotel. Our intrepid mountaineers will return mid-morning and have the rest of the day to chill out or explore Ubud.
Gili Air
Time to leave the green pastures of Ubud and move onto the bluest of waters. Day 5 has us Cruising to the famous Gili Islands. Travelling via fast ferry. We will arrive at our perfectly positioned resort on Gili Air. This is the quintessential island retreat from which to enjoy the beach and explore the island. Drop your bags, grab a cocktail and enjoy paradise… Cheers!
Gili Air, Private Boat Trip, see Turtles – Bicycle Ride - Sunset Swing
No Bali trip would be complete without a private boat tour of some of the clearest waters in the world and the famous 3 Gili islands. With many stunning underwater snorkeling spots, our boat will stop only at its best. We promise the chance to swim with turtles and a selection of tropical rainbow-coloured fish. After lunch, we jump on bicycles for a leisurely pedal around the island. Stop on the beach and take in the view whilst enjoying a fresh coconut. Remember to get that famous swing shot for Instagram!
Nusa Lembongan, Devils Tear
Today we say goodbye to the Gili Islands, and we will be making our way to the relatively unexplored island of Nusa Lembongan. We will have the morning in Gili Air to have a lazy brunch or another cycle around before the boat leaves around lunch time. We will arrive in time to watch another amazing sunset from the legendary Devil's Tear viewpoint.
Nusa Lembongan, Manta Rays
Day 8 is a free day, but not before we have gone snorkeling with Manta Rays!! After
breakfast, your guide can help you organize extra activates such as SUP, Surf Lesson or
massages! After sunset, we will be heading out for dinner at another of our fave restaurants which
serves you western meals as well as classic Indonesian cuisine. Tonight your
guide will also help to start to plan your onward travel.
Nusa Penida
Today will sadly be our final full day of the trip. However, we have saved the best for last! Nusa Penida!! We take in the Mangroves before making our way to Nusa Penida. Take iconic photos high above Kelingking Beach & Billabong Beach. After lunch, we will go and chill at the wonderful Crystal Bay. Then back to Nusa Lembongan before catching one last incredible sunset together. Tonight we will have a group meal and reminisce over all the photos from the week before heading out for one last drink together.
Return back to Bali
Today we say goodbye to each other as we go our separate ways! Hopefully not many tears will be shed. Don’t forget to get one last group photo!

Age
You must be aged 21 or over at the time of the start of the tour.
Passports
You must have a valid passport with at least 6 months left before expire and one clear full page.
Travel Insurance
To be allowed on the tour you must have travel insurance for the time you are on the trip. You will be asked for a printed copy of this by your group leader on arrival. You will not be permitted on the tour if you cannot produce a printed copy. The insurance must cover medial emergency’s and all cancelation costs.
Flight details
In order for us to collect you from the airport we will need your full flight details:
- Flight number
- Time of arrival
- Name of airline
- We will need these details 14 days before your arrival.
Deposit
A £49 deposit is required before we can guarantee a place your requested tour. The deposit is non-refundable under any circumstances. The full amount must be paid 1 month before the tour start date. For both bookings and deposit you will receive an automatic email confirming payment.
Date Changes to your booking
We try to be as flexible as possible when it comes to date changes. If you wish to change the start date of your tour you must let us know 7 days prior to the start of the date. We cannot move your tour date within 7 days of the tour starting. You can change your date unlimited times for 18 months after the original tour date – Free are charge. No refunds will be given after the original start date.
Cancellation policy
Plans can change, and we understand life happens – our cancellation policy depends on who is making the cancellation. Please take the time to read through the below information:
Cancellations – by you
We will allow you to change dates unlimited times under the condition above for 18 months. If you fail to make contact and have not arrived by the agreed start date, we are entitled to treat the tour as having been cancelled – by you.
Bookings cancelled and rebooked in a promotional period with a discount will be void of any savings and original price will be charged.
No cancellation fees will be waived as a result of the following:
- Injury or sickness
- Delayed, rescheduled or missed flights
- Climatic, social or political problems
- Pandemics, Epidemics, Bird flu, Swine flu or SARS.
- Any other form of ‘Force Majeure’
- You may be able to have your cancellation fees refunded by your Travel Insurance Company depending on their terms – that’s why it’s also very important you arrange travel insurance before coming on tour!
Cancellations by us:
We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip, you can transfer amounts paid to an alternative start date or in circumstances where cancellation is due to external events outside our reasonable control, refunds will be given less any unrecoverable expenses. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including, but not limited to, visas, vaccinations, travel insurance excess or non-refundable flights.
In the very rare event that we do not receive the minimum number of bookings to provide the trip, we, at our discretion, shall be entitled to cancel or curtail the trip at any time up to seven days prior to the start date. We will always move you to the nearest group so as not to disrupt your plans too much. This is also to ensure that there are enough people in the group to make it the most possible fun for you! If this occurs and it is not possible for you to participate in a trip with a different start date we will give a full refund, however you shall not be entitled to make any claim for loss arising as a consequence of cancellation or curtailment in these circumstances.
Changes to Itinerary
We will always try to keep to the original advertised itinerary although sometimes some situations may be beyond our control and we have to change activates.
Privacy Policy
Any personal information that we collect about you may be used for any purpose associated with the operation of a trip or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the trip. Other than that we won’t ever email you unless it’s for a necessary, legitimate reason. And we won’t give your email address or personal information to anyone else. We take appropriate technical and organisational measures which are intended to prevent unauthorised or unlawful processing of personal data and accidental loss or destruction of, or damage to, personal data. If you believe that any of your personal data which we are processing is inaccurate or incorrect please contact us immediately.

BALI BUCKET LIST TOURS TERMS AND CONDITIONS OF SALE (applicable to bookings made before June 1st, 2020)
Please take the time to read and understand the conditions of booking set out below prior to booking a trip Bali Bucket List Tours Ltd (BBLT). We strongly recommend that you also read the Essential Trip Information relating to your trip prior to booking to ensure that you understand the itinerary, style and physical demands of the trip you are undertaking.
1. THE BOOKING CONTRACT
Your booking is confirmed and a contract exists when the Tour Operator (BBLT) or your travel agent issues a written confirmation after receipt of the applicable deposit amount. Please check your confirmation carefully and report any incorrect or incomplete information to the Tour Operator or authorized agent immediately. Please ensure that names are exactly as stated in the relevant passport.
You must be at least 18 years of age to make a booking. You agree to provide full, complete and accurate information to the Tour Operator.
2. VALIDITY
Dates and itineraries are valid until 31 December 2019. Beyond 31 December 2019 dates and itineraries are indicative only.
3. YOUR DETAILS AND BOOKING ON BEHALF OF OTHERS
By booking for yourself as a solo traveller or on behalf of other participants as a group, you are deemed to be the designated contact person for every participant included on that booking. This means that you are responsible for making all payments due in connection with your Tour booking, notifying the Tour Operator or your travel agent if any changes or cancellations are required and keeping your party informed.
By booking on behalf of another person or persons, you represent and warrant that you have obtained all required consents. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate and the Tour Operator will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.
4. DEPOSIT REQUIREMENT AND BOOKING FORM
You are required to pay a non-refundable deposit of £200 per person per trip for your booking to be confirmed. If your booking is made within 30 days of the departure date then the full amount is payable at the time of booking. If you are booking though a third party travel agency, or if you are booking directly with BBLT, you will be required to complete an online booking form submitting all your personal information details, along with any people in your group along with the details of your specific trip. If you are booking though a booking agent, you may be asked to complete a booking form by the agent, however BBLT T&C will prevail.
5. ACCEPTANCE OF BOOKING AND FINAL PAYMENTS
If we accept your booking we will issue a confirmation invoice. A contract will exist between us from the date we issue the confirmation invoice or if you book within 30 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments. Payment of the balance of the trip price is due 30 days before the departure date. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled, however we will send you written communication to inform you that your balance is due if we have not heard from you.
6. IF YOU CHANGE YOUR BOOKING
a) An administration fee of £75 per booking plus any additional costs or charges incurred by us or incurred or imposed by any of our suppliers will be charged if a confirmed booking is changed or transferred to a different departure date or tour, up to 30 days prior to departure. Thereafter all changes will be treated as cancellations and subject to the charges below. Changes are subject to availability and you must resubmit a new booking form.
b) If a client is unable to travel, in circumstances which the Company considers reasonable, the booking or that client’s place on the booking may be transferred to another suitable person (introduced by you). However, the tour arrangements must remain the same as originally booked. If a transfer can be made, an administration charge of £75 per person transferring his/her place if the Company is advised up to your balance due date, after your balance due date it is not possible to transfer a client’s place to another suitable person.
7. IF YOU CANCEL YOUR BOOKING
Should the client wish to cancel, cancellation charges will be imposed. These are calculated from the day written notification is received by the Company or their authorised travel agent as a percentage of the total tour price per person cancelling, excluding any amendment charges. The cancellation charges shown below are those which will apply to all tours.
a) 90 and more days before tour start date – retention of deposit
b) 45-89 days before tour start date – 50% of balance or retention of deposit if higher
c) 30-45 days before tour start date – 75%
d) 29-0 days before tour start date – 100%
Amendment charges are not refundable in the event of cancellation. It is strongly recommended that comprehensive travel insurance is taken out which includes cover against cancellation charges. Depending on the reason for the cancellation, you may be able to reclaim the cancellation charges (less any applicable excess) under the terms of the insurance policy. All claims must be made direct to the insurance company. In the event of the cancellation of a booking where the client is liable to pay to the Company cancellation charges in excess of the amount already paid to the Company at the time of cancellation, the client cannot transfer or add these charges to another booking or use any amounts paid to us in relation to the cancelled booking by way of part payment for another booking. To clarify all additional extras, single supplements, pre and post tour nights, and experiences will incur 100% cancellation charges up to 90 days before the tour start date.
8. CHANGE BY US
While we endeavor to operate all trips as described we reserve the right to change the trip itinerary. If it necessary for us to change aspect of your tour in advance of your departure date, we will notify you in writing in advance.
Before departure: If we make a major change we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least two days in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative tour offered.
After departure: We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control. In such emergency circumstances the additional cost of any necessary itinerary alterations will be covered by BBLT. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itinerary such as visas, vaccinations or non-refundable flights.
9. CANCELLATION BY US
Our trips are guaranteed to depart once they have one fully paid traveller unless minimum group size specifically states otherwise. We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary (See Force Majeure fig.17) . If we cancel your trip, you can transfer amounts paid to an alternate departure date or receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.
10. TRAVEL AND CANCELLATION INSURANCE
Travel Insurance is mandatory for all clients whilst on a tour organised by the Company. Clients together with their personal property including baggage are at all times solely at their own risk. Clients are wholly responsible for arranging their own insurance. Clients not taking out the Company’s specially arranged travel/cancellation insurance are responsible for ensuring that they have alternative personal travel insurance with protection for the full duration of the tour in respect of at least medical expenses, injury, death, repatriation, cancellation and curtailment, with adequate and appropriate cover. Clients making their own arrangements should ensure that there are no exclusion clauses limiting or excluding protection for the type of activities included in their tour. Clients should satisfy themselves that all travel insurance purchased meets their particular requirements and should arrange supplementary insurance if need be.
11. IF YOU HAVE A COMPLAINT
We make every effort to ensure that your tour arrangements run smoothly but if you do have a problem during your tour, please inform our Tour Guide immediately who will endeavour to put things right. If your complaint is not resolved locally, please contact us via email at [email protected].
If the problem cannot be resolved and you wish to complain further, you must send formal written notice of your complaint to us at our office within 7 days of the end of your stay, giving your booking reference and all other relevant information. Please keep your letter concise and to the point. This will assist us to quickly identify your concerns and speed up our response to you.
Please Note: Failure to follow the procedure set out in this clause may affect ours and the applicable supplier’s ability to investigate your complaint, and will affect your rights under this contract.

12. INCLUSIONS
The land price of your trip includes:
• all accommodation as listed in the Essential Trip Information
• all transport listed in the Essential Trip Information
• sightseeing and meals as listed in the Essential Trip Information
• the services of a group leader as described in the Essential Trip Information
• Airport transfers where specified
13. EXCLUSIONS
The land price of your trip does not include:
• international or internal flights. Please make your own arrangement
• Taxes and excess baggage charges unless specified
• meals other than those specified in the Essential Trip Information
• Visa and passport fees
• travel insurance
• Optional activities and all personal expenses
14. PASSPORTS, VISAS AND VACCINATIONS
You are responsible for arranging, and must be in possession of, a valid, acceptable passport and any visas and vaccination certificates required for the whole of their journey and tour. Information about these matters or related items (climate, clothing, baggage, personal gear etc) is given in good faith but without responsibility on the part of the Company. We regret we cannot accept any liability if you are refused entry onto any transport or into any country due to failure on your part to carry all required documentation. If failure to have any necessary travel or other documents results in fines, surcharges or other financial penalty being imposed on us, you will be responsible for reimbursing us accordingly.
18. AUTHORITY ON TOUR
Our group trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.
16. ACCEPTANCE OF RISK
You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However it is also your own responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.
17. FORCE MAJEURE
Except where otherwise expressly stated in these conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any injury, damage, loss or expense of any nature as a result of “force majeure”. In these conditions, “force majeure” means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include whether actual or threatened war, riot, civil strife, terrorist activity, industrial dispute, collapse of telecommunications, natural or nuclear disaster, adverse weather conditions, disease, fire, flood and all similar events outside our control.
18. LIMITATION OF LIABILITY
a. We will accept liability for the negligence of our staff or agents causing death or physical injury to persons or loss or damage to personal property only to the extent it is obliged under the applicable law. Our obligations, and those of our suppliers providing any service or facility included in your holiday, are to take reasonable skill and care to arrange for the provision of such services and facilities. This acceptance of liability is subject to clause c. below.
b. In other circumstances we are responsible to you for the proper performance of this contract. This acceptance of liability is subject to clause c. below.
c. we shall not be liable for any damage or loss if the failure to carry out the contract is:
attributable to you.
attributable to a third party unconnected with the provision of the services contracted for and the event is unforeseeable or unavoidable.
due to unforeseen and unusual circumstances beyond our control, the consequences of which could not have been avoided even if all due care had to be exercised.
due to political disputes, border closures, refusal of visas, industrial action, climate or other matters of a similar nature and any other force majeure.
due to an event which the Company, even with all due care, could not foresee or forestall.
d. Except in cases involving death, injury or illness, any liability covered under clause b. above is limited to3 times the price paid. In the case of damaged property the liability is limited to a maximum amount equal to the amount paid by or on behalf of the owner of the property. In all cases the Company specifically excludes all liability for indirect or consequential loss or expense including loss of profits and in all cases our liability will be limited in accordance with and/or in an identical manner to the contractual terms of the companies that provide the transportation for your travel arrangements.
e. Where your trip arrangements involve travel by air, rail or sea, or hotel accommodation, the compensation is limited by the following international conventions respectively: Warsaw Convention as amended 1955, Bern Convention 1961, Athens Convention 1974 and Paris Convention 1962. We are to be regarded as having all benefit of any limitation of right to claim or compensation contained in these or any conventions..
f. our acceptance of liability in clauses a and b above is subject to assignment by you of your rights against any agent, supplier or sub-contractor which is in any way responsible for the unsatisfactory arrangements or your death or personal injury.
19. LATE BOOKINGS AND SINGLE OCCUPANCY SURCHARGE
We emphasise the importance of making a booking at the earliest opportunity, because of the small group nature of our tours.
For bookings received within 30 days of the start of your tour, we reserve the right to pass on any extra costs incurred. For bookings received within 30 days, the contract between the BBLT and the client comes into existence as soon as full payment has been received by the BBLT. It is advised that late bookings or last space bookings wait utill they get written confirmation of the tour being available before booking flights and other additional costs that you may wish to pay for in order to partake in the tour. All ours are subject to availability. There will be no compensation paid for any flights or additional extras paid if booked on a tour which is unavailable if booked before receiving written confirmation from BBLT.
All accommodation is based on two people sharing a twin room. If you wish to reserve single occupancy accommodation, or if you are a group of thee people and do not wish one member of your group to share accommodation with another solo traveller or guide, we offer a single occupancy surcharge which is £100 additional on the tour fee to cover all accommodation for the tour. This must be requested at the time of booking. We will endeavour to honour any requests during the tour, however due to the nature of our operation, this is strictly subject to availability however our tour guide will try to make this possible. On tour requests may incur a larger surcharge of up to £200 and this must be paid in the local currency in cash to the tour guide in order for the tour guide to pay the relevant accommodation.
20. OPTIONAL ACTIVITIES
Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance given by your group leader or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and activity provider. We do not recommend scooter or golf buggy hire as all our accommodation is located within the destinations local amenities and we will not be responsible for any accident, injury or death caused due to a failure on your behalf to adhere to our recommendations. Some accommodation offer bicycle hire but again this is at your own risk.
21. PHOTOS AND MARKETING
You consent to us using images of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes. At some locations, our guide will recommend photo opportunities to be taken and posted on social media requesting you to tag or add the Bali Bucket List tour handle or the venue handle to the post. You reserve the right to decline this request at your own free will.
22. Data protection and privacy statement
For the purposes of the Data Protection Act 1998, we, BBLT, are a data controller. In order to process your booking and brochure requests, provide your tour and to help us give you a more personal service, we need to collect certain personal details from you. These details will include, where applicable, the names and contact details of party members, credit or debit card or other payment details and special requirements such as those relating to any disability or medical condition which may affect the chosen tour arrangements and any dietary restrictions which may disclose your religious beliefs. If we need any other personal details, we will tell you before we obtain them from you. We need to pass on your personal details to the companies and organisations who need to know them so that your tour can be provided (for example, hotel, other supplier, credit/debit card company or bank). Such companies and organisations may be outside the European Union. We would also like to store and use your personal details for future marketing purposes (for example, sending you a brochure or details of new features, tours or special offers which we think may be of interest to you, including by email). All details you give us in connection with your booking (including those relating to any disability or medical condition or your religious beliefs) will be kept but we will use only names and contact details for marketing purposes (unless you have indicated that you do not wish us to do so. We respect your privacy and do not sell, rent, trade or give away any of your personal information for any purpose. Occasionally we hire other companies to provide services on our behalf, for example to mail information to you. We only provide those companies with the personal details relating to you which they require in order to deliver the service we ask them to deliver. They are prohibited from using that information for any other purpose. We will ensure that anyone to whom we pass your details for this reason agrees to treat it with the same level of protection we are obliged to provide. If you do not want us to do any or all of these things, please let us know as soon as possible. Except where expressly permitted by the Data Protection Act, we will only deal with the personal details you give us as set out above unless you agree otherwise. We have appropriate security measures in place to protect this information. You are generally entitled to ask us (by letter or e-mail) what details of yours are being held or processed, for what purpose and to whom they may be or have been disclosed. We will charge a fee to respond to such a request. We promise to respond to your request within 40 days of receiving your written request and fee. In certain limited circumstances we are entitled to refuse your request. If you believe that any of your personal details which we are processing are inaccurate or incorrect please contact us immediately. As our privacy statement may change due to developments in the law, we would encourage you to reread our privacy statement from time to time so that you are aware of any changes in how we gather and use personal information. Please note calls may be recorded for training and monitoring purposes.
23. OUR RESPONSIBILITY FOR YOUR TOUR
Bookings are accepted on the understanding that clients appreciate and accept the possible risks inherent in adventure travel and that they undertake the tours, treks or expeditions featured in our programme at their own volition.
(1) We promise to make sure that the tour arrangements we have agreed to make, perform or provide, as applicable, as part of our contract with you are made, performed or provided with reasonable skill and care. This means that, subject to these conditions and the other information which forms part of your contract with us, we will accept responsibility if, for example, you suffer death or personal injury or your contracted tour arrangements are not provided as promised or prove deficient as a result of the failure of ourselves, our employees, agents or suppliers to use reasonable skill and care in making, performing or providing, as applicable, your contracted tour arrangements. Please note, it is your responsibility to show that reasonable skill and care has not been used if you wish to make a claim against us. In addition, we will only be responsible for what our employees, agents and suppliers do or do not do if they were at the time acting within the course of their employment (for employees) or carrying out work we had asked them to do (for agents and suppliers).
(2) We will not be responsible for any injury, illness, death, loss (including loss possessions and loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following: –
the act(s) and/or omission(s) of the client(s) affected or any member(s) of their party or the act(s) and/or omission(s) of a third party not connected with the provision of your tour and which were unforeseeable or unavoidable or
‘force majeure’ as defined in clause 17 above
(3) Please note, we cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities which any supplier agrees to provide for you where the services or facilities are not advertised by us and we have not agreed to arrange them as part of our contract. Any optional excursions or activities booked during your holiday do not form part of our contract as these are all arranged for you directly by the suppliers concerned – please see clause 20 Optional activities above. In addition, regardless of any wording used by us on our website, in any advertising material or elsewhere, we only promise to use reasonable skill and care as set out above and we do not have any greater or different liability to you.
(4) The promises we make to you about the services we have agreed to provide or arrange as part of our contract – and the laws and regulations of the country in which your claim or complaint occurred – will be used as the basis for deciding whether the services in question had been properly provided. Please bear in mind that standards of, for example, safety, hygiene, and quality may vary throughout the destinations, services and transport your tour involves and may be lower than or different to those applicable in the UK. If the particular services which gave rise to the claim or complaint complied with the local laws and regulations applicable to those services at the time, the services will be treated as having been properly provided. This will be the case even if the services did not comply with the laws and regulations of the UK which would have applied had those services been provided in the UK. The exception to this is where the claim or complaint concerns the absence of a safety feature which might lead a reasonable holiday maker to refuse to take the tour in question.
(5) As set out in these conditions, we limit the maximum amount we may have to pay you for any claims you may make against us. We do not, however, limit or exclude our liability for death or personal injury caused by the negligence of ourselves or our employees (providing they were at the time acting within the course of their employment).
For all other claims which do not involve death or personal injury, if we are found liable to you on any basis, the maximum amount we will have to pay you is the price (excluding insurance premiums and amendment charges) paid by or on behalf of the person(s) affected in total unless a lower limitation applies to your claim under clause 23 (6) below. This maximum amount will only be payable where everything has gone wrong and you have not received any benefit at all from your tour.
(6) Where any claim or part of a claim (including those involving death or personal injury) concerns or is based on any travel arrangements (including the process of getting on and/or off the transport concerned) provided by any air, sea, rail or road carrier, the maximum amount of compensation we will have to pay you will be limited. The most we will have to pay you for that claim or that part of a claim if we are found liable to you on any basis is the most the carrier concerned would have to pay under the international convention or regulation which applies to the travel arrangements in question were that claim made against it (for example, the Warsaw Convention 1929 as amended or unamended and the Montreal Convention 1999 for international travel by air and/or for airlines with an operating licence granted by an EU country, the EC Regulation on Air Carrier Liability No 889/2002 for national and international travel by air, the Athens Convention 1974 for international travel by sea and COTIF, the Convention on International Travel by Rail. Please note: where a carrier would not be obliged to make any payment to you under the applicable international convention or regulation in respect of a claim or part of a claim, we similarly are not obliged to make a payment to you for that claim or part of the claim. When making any payment, we are entitled to deduct any money which you have received or are entitled to receive from the carrier or hotelier for the complaint or claim in question. Copies of the applicable international conventions and regulations are available from us on request.
(7) Please note, we cannot accept any liability for any damage, loss, expense or other sum(s) of any description (1) which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you or (2) which did not result from any breach of contract or other fault by ourselves or our employees or, where we are responsible for them, our suppliers. Additionally we cannot accept liability for any expenses or losses incurred by or relating to any business including self-employed loss of earnings.
(8) You must provide ourselves and our insurers with all assistance we may reasonably require. You must also tell us and the supplier concerned about your claim or complaint as set out in clause 11. If You have a Complaint. If asked to do so, you must transfer to us or our insurers any rights you have against the supplier or whoever else is responsible for your claim or complaint.
27. APPLICABLE LAW
The laws of the United Kingdom govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of the United Kingdom.

Age
You must be aged 21 or over at the time of the start of the tour.
Passports
You must have a valid passport with at least 6 months left before expire and one clear full page.
Travel Insurance
To be allowed on the tour you must have travel insurance for the time you are on the trip. You will be asked for a printed copy of this by your group leader on arrival. You will not be permitted on the tour if you cannot produce a printed copy. The insurance must cover medial emergency’s and all cancelation costs.
Flight details
In order for us to collect you from the airport we will need your full flight details:
- Flight number
- Time of arrival
- Name of airline
We will need these details 14 days before your arrival.
Deposit
A £49 deposit is required before we can guarantee a place your requested tour. The deposit is non-refundable under any circumstances. The full amount must be paid 1 month before the tour start date. For both bookings and deposit you will receive an automatic email confirming payment.
Date Changes to your booking
We try to be as flexible as possible when it comes to date changes. If you wish to change the start date of your tour you must let us know 7 days prior to the start of the date. We cannot move your tour date within 7 days of the tour starting. You can change your date unlimited times for 18 months after the original tour date – Free are charge. No refunds will be given after the original start date.
Cancellation policy
Plans can change, and we understand life happens – our cancellation policy depends on who is making the cancellation. Please take the time to read through the below information:
Cancellations – by you
- If you cancel your booking more than 7 days prior to the start date of your trip you will receive a full refund, less the £49 deposit
- No refunds will be available if you cancel within 7 days of the start date of your trip
- We will allow you to change dates unlimited times under the condition above for 18 months. If you fail to make contact and have not arrived by the agreed start date, we are entitled to treat the tour as having been cancelled – by you.
- Bookings cancelled and rebooked in a promotional period with a discount will be void of any savings and original price will be charged.
No cancellation fees will be waived as a result of the following:
- Injury or sickness
- Delayed, rescheduled or missed flights
- Climatic, social or political problems
- Pandemics, Epidemics, Bird flu, Swine flu or SARS.
- Any other form of ‘Force Majeure’
You may be able to have your cancellation fees refunded by your Travel Insurance Company depending on their terms – that’s why it’s also very important you arrange travel insurance before coming on tour!
Cancellations by us:
We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip, you can transfer amounts paid to an alternative start date or in circumstances where cancellation is due to external events outside our reasonable control, refunds will be given less any unrecoverable expenses. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including, but not limited to, visas, vaccinations, travel insurance excess or non-refundable flights.
In the very rare event that we do not receive the minimum number of bookings to provide the trip, we, at our discretion, shall be entitled to cancel or curtail the trip at any time up to seven days prior to the start date. We will always move you to the nearest group so as not to disrupt your plans too much. This is also to ensure that there are enough people in the group to make it the most possible fun for you! If this occurs and it is not possible for you to participate in a trip with a different start date we will give a full refund, however you shall not be entitled to make any claim for loss arising as a consequence of cancellation or curtailment in these circumstances.
Changes to Itinerary
We will always try to keep to the original advertised itinerary although sometimes some situations may be beyond our control and we have to change activates.
Privacy Policy
Any personal information that we collect about you may be used for any purpose associated with the operation of a trip or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the trip. Other than that we won’t ever email you unless it’s for a necessary, legitimate reason. And we won’t give your email address or personal information to anyone else. We take appropriate technical and organisational measures which are intended to prevent unauthorised or unlawful processing of personal data and accidental loss or destruction of, or damage to, personal data. If you believe that any of your personal data which we are processing is inaccurate or incorrect please contact us immediately.

BALI BUCKET LIST TOURS TERMS AND CONDITIONS OF SALE (applicable to bookings made before June 1st, 2020)
Please take the time to read and understand the conditions of booking set out below prior to booking a trip Bali Bucket List Tours Ltd (BBLT). We strongly recommend that you also read the Essential Trip Information relating to your trip prior to booking to ensure that you understand the itinerary, style and physical demands of the trip you are undertaking.
1. THE BOOKING CONTRACT
Your booking is confirmed and a contract exists when the Tour Operator (BBLT) or your travel agent issues a written confirmation after receipt of the applicable deposit amount. Please check your confirmation carefully and report any incorrect or incomplete information to the Tour Operator or authorized agent immediately. Please ensure that names are exactly as stated in the relevant passport.
You must be at least 18 years of age to make a booking. You agree to provide full, complete and accurate information to the Tour Operator.
2. VALIDITY
Dates and itineraries are valid until 31 December 2019. Beyond 31 December 2019 dates and itineraries are indicative only.
3. YOUR DETAILS AND BOOKING ON BEHALF OF OTHERS
By booking for yourself as a solo traveller or on behalf of other participants as a group, you are deemed to be the designated contact person for every participant included on that booking. This means that you are responsible for making all payments due in connection with your Tour booking, notifying the Tour Operator or your travel agent if any changes or cancellations are required and keeping your party informed.
By booking on behalf of another person or persons, you represent and warrant that you have obtained all required consents. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate and the Tour Operator will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.
4. DEPOSIT REQUIREMENT AND BOOKING FORM
You are required to pay a non-refundable deposit of £200 per person per trip for your booking to be confirmed. If your booking is made within 30 days of the departure date then the full amount is payable at the time of booking. If you are booking though a third party travel agency, or if you are booking directly with BBLT, you will be required to complete an online booking form submitting all your personal information details, along with any people in your group along with the details of your specific trip. If you are booking though a booking agent, you may be asked to complete a booking form by the agent, however BBLT T&C will prevail.
5. ACCEPTANCE OF BOOKING AND FINAL PAYMENTS
If we accept your booking we will issue a confirmation invoice. A contract will exist between us from the date we issue the confirmation invoice or if you book within 30 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments. Payment of the balance of the trip price is due 30 days before the departure date. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled, however we will send you written communication to inform you that your balance is due if we have not heard from you.
6. IF YOU CHANGE YOUR BOOKING
a) An administration fee of £75 per booking plus any additional costs or charges incurred by us or incurred or imposed by any of our suppliers will be charged if a confirmed booking is changed or transferred to a different departure date or tour, up to 30 days prior to departure. Thereafter all changes will be treated as cancellations and subject to the charges below. Changes are subject to availability and you must resubmit a new booking form.
b) If a client is unable to travel, in circumstances which the Company considers reasonable, the booking or that client’s place on the booking may be transferred to another suitable person (introduced by you). However, the tour arrangements must remain the same as originally booked. If a transfer can be made, an administration charge of £75 per person transferring his/her place if the Company is advised up to your balance due date, after your balance due date it is not possible to transfer a client’s place to another suitable person.
7. IF YOU CANCEL YOUR BOOKING
Should the client wish to cancel, cancellation charges will be imposed. These are calculated from the day written notification is received by the Company or their authorised travel agent as a percentage of the total tour price per person cancelling, excluding any amendment charges. The cancellation charges shown below are those which will apply to all tours.
a) 90 and more days before tour start date – retention of deposit
b) 45-89 days before tour start date – 50% of balance or retention of deposit if higher
c) 30-45 days before tour start date – 75%
d) 29-0 days before tour start date – 100%
Amendment charges are not refundable in the event of cancellation. It is strongly recommended that comprehensive travel insurance is taken out which includes cover against cancellation charges. Depending on the reason for the cancellation, you may be able to reclaim the cancellation charges (less any applicable excess) under the terms of the insurance policy. All claims must be made direct to the insurance company. In the event of the cancellation of a booking where the client is liable to pay to the Company cancellation charges in excess of the amount already paid to the Company at the time of cancellation, the client cannot transfer or add these charges to another booking or use any amounts paid to us in relation to the cancelled booking by way of part payment for another booking. To clarify all additional extras, single supplements, pre and post tour nights, and experiences will incur 100% cancellation charges up to 90 days before the tour start date.
8. CHANGE BY US
While we endeavor to operate all trips as described we reserve the right to change the trip itinerary. If it necessary for us to change aspect of your tour in advance of your departure date, we will notify you in writing in advance.
Before departure: If we make a major change we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least two days in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative tour offered.
After departure: We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control. In such emergency circumstances the additional cost of any necessary itinerary alterations will be covered by BBLT. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itinerary such as visas, vaccinations or non-refundable flights.
9. CANCELLATION BY US
Our trips are guaranteed to depart once they have one fully paid traveller unless minimum group size specifically states otherwise. We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary (See Force Majeure fig.17) . If we cancel your trip, you can transfer amounts paid to an alternate departure date or receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.
10. TRAVEL AND CANCELLATION INSURANCE
Travel Insurance is mandatory for all clients whilst on a tour organised by the Company. Clients together with their personal property including baggage are at all times solely at their own risk. Clients are wholly responsible for arranging their own insurance. Clients not taking out the Company’s specially arranged travel/cancellation insurance are responsible for ensuring that they have alternative personal travel insurance with protection for the full duration of the tour in respect of at least medical expenses, injury, death, repatriation, cancellation and curtailment, with adequate and appropriate cover. Clients making their own arrangements should ensure that there are no exclusion clauses limiting or excluding protection for the type of activities included in their tour. Clients should satisfy themselves that all travel insurance purchased meets their particular requirements and should arrange supplementary insurance if need be.
11. IF YOU HAVE A COMPLAINT
We make every effort to ensure that your tour arrangements run smoothly but if you do have a problem during your tour, please inform our Tour Guide immediately who will endeavour to put things right. If your complaint is not resolved locally, please contact us via email at [email protected].
If the problem cannot be resolved and you wish to complain further, you must send formal written notice of your complaint to us at our office within 7 days of the end of your stay, giving your booking reference and all other relevant information. Please keep your letter concise and to the point. This will assist us to quickly identify your concerns and speed up our response to you.
Please Note: Failure to follow the procedure set out in this clause may affect ours and the applicable supplier’s ability to investigate your complaint, and will affect your rights under this contract.

12. INCLUSIONS
The land price of your trip includes:
• all accommodation as listed in the Essential Trip Information
• all transport listed in the Essential Trip Information
• sightseeing and meals as listed in the Essential Trip Information
• the services of a group leader as described in the Essential Trip Information
• Airport transfers where specified
13. EXCLUSIONS
The land price of your trip does not include:
• international or internal flights. Please make your own arrangement
• Taxes and excess baggage charges unless specified
• meals other than those specified in the Essential Trip Information
• Visa and passport fees
• travel insurance
• Optional activities and all personal expenses
14. PASSPORTS, VISAS AND VACCINATIONS
You are responsible for arranging, and must be in possession of, a valid, acceptable passport and any visas and vaccination certificates required for the whole of their journey and tour. Information about these matters or related items (climate, clothing, baggage, personal gear etc) is given in good faith but without responsibility on the part of the Company. We regret we cannot accept any liability if you are refused entry onto any transport or into any country due to failure on your part to carry all required documentation. If failure to have any necessary travel or other documents results in fines, surcharges or other financial penalty being imposed on us, you will be responsible for reimbursing us accordingly.
18. AUTHORITY ON TOUR
Our group trips are run by a group leader. The decision of the group leader is final on all matters likely to affect the safety or well-being of any traveller or staff member participating in the trip. If you fail to comply with a decision made by a group leader, or interfere with the well-being or mobility of the group, the group leader may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with our responsible travel guidelines.
16. ACCEPTANCE OF RISK
You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However it is also your own responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.
17. FORCE MAJEURE
Except where otherwise expressly stated in these conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our obligations under our contract with you is prevented or affected by or you otherwise suffer any injury, damage, loss or expense of any nature as a result of “force majeure”. In these conditions, “force majeure” means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include whether actual or threatened war, riot, civil strife, terrorist activity, industrial dispute, collapse of telecommunications, natural or nuclear disaster, adverse weather conditions, disease, fire, flood and all similar events outside our control.
18. LIMITATION OF LIABILITY
a. We will accept liability for the negligence of our staff or agents causing death or physical injury to persons or loss or damage to personal property only to the extent it is obliged under the applicable law. Our obligations, and those of our suppliers providing any service or facility included in your holiday, are to take reasonable skill and care to arrange for the provision of such services and facilities. This acceptance of liability is subject to clause c. below.
b. In other circumstances we are responsible to you for the proper performance of this contract. This acceptance of liability is subject to clause c. below.
c. we shall not be liable for any damage or loss if the failure to carry out the contract is:
attributable to you.
attributable to a third party unconnected with the provision of the services contracted for and the event is unforeseeable or unavoidable.
due to unforeseen and unusual circumstances beyond our control, the consequences of which could not have been avoided even if all due care had to be exercised.
due to political disputes, border closures, refusal of visas, industrial action, climate or other matters of a similar nature and any other force majeure.
due to an event which the Company, even with all due care, could not foresee or forestall.
d. Except in cases involving death, injury or illness, any liability covered under clause b. above is limited to3 times the price paid. In the case of damaged property the liability is limited to a maximum amount equal to the amount paid by or on behalf of the owner of the property. In all cases the Company specifically excludes all liability for indirect or consequential loss or expense including loss of profits and in all cases our liability will be limited in accordance with and/or in an identical manner to the contractual terms of the companies that provide the transportation for your travel arrangements.
e. Where your trip arrangements involve travel by air, rail or sea, or hotel accommodation, the compensation is limited by the following international conventions respectively: Warsaw Convention as amended 1955, Bern Convention 1961, Athens Convention 1974 and Paris Convention 1962. We are to be regarded as having all benefit of any limitation of right to claim or compensation contained in these or any conventions..
f. our acceptance of liability in clauses a and b above is subject to assignment by you of your rights against any agent, supplier or sub-contractor which is in any way responsible for the unsatisfactory arrangements or your death or personal injury.
19. LATE BOOKINGS AND SINGLE OCCUPANCY SURCHARGE
We emphasise the importance of making a booking at the earliest opportunity, because of the small group nature of our tours.
For bookings received within 30 days of the start of your tour, we reserve the right to pass on any extra costs incurred. For bookings received within 30 days, the contract between the BBLT and the client comes into existence as soon as full payment has been received by the BBLT. It is advised that late bookings or last space bookings wait utill they get written confirmation of the tour being available before booking flights and other additional costs that you may wish to pay for in order to partake in the tour. All ours are subject to availability. There will be no compensation paid for any flights or additional extras paid if booked on a tour which is unavailable if booked before receiving written confirmation from BBLT.
All accommodation is based on two people sharing a twin room. If you wish to reserve single occupancy accommodation, or if you are a group of thee people and do not wish one member of your group to share accommodation with another solo traveller or guide, we offer a single occupancy surcharge which is £100 additional on the tour fee to cover all accommodation for the tour. This must be requested at the time of booking. We will endeavour to honour any requests during the tour, however due to the nature of our operation, this is strictly subject to availability however our tour guide will try to make this possible. On tour requests may incur a larger surcharge of up to £200 and this must be paid in the local currency in cash to the tour guide in order for the tour guide to pay the relevant accommodation.
20. OPTIONAL ACTIVITIES
Optional activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance given by your group leader or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and activity provider. We do not recommend scooter or golf buggy hire as all our accommodation is located within the destinations local amenities and we will not be responsible for any accident, injury or death caused due to a failure on your behalf to adhere to our recommendations. Some accommodation offer bicycle hire but again this is at your own risk.
21. PHOTOS AND MARKETING
You consent to us using images of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes. At some locations, our guide will recommend photo opportunities to be taken and posted on social media requesting you to tag or add the Bali Bucket List tour handle or the venue handle to the post. You reserve the right to decline this request at your own free will.
22. Data protection and privacy statement
For the purposes of the Data Protection Act 1998, we, BBLT, are a data controller. In order to process your booking and brochure requests, provide your tour and to help us give you a more personal service, we need to collect certain personal details from you. These details will include, where applicable, the names and contact details of party members, credit or debit card or other payment details and special requirements such as those relating to any disability or medical condition which may affect the chosen tour arrangements and any dietary restrictions which may disclose your religious beliefs. If we need any other personal details, we will tell you before we obtain them from you. We need to pass on your personal details to the companies and organisations who need to know them so that your tour can be provided (for example, hotel, other supplier, credit/debit card company or bank). Such companies and organisations may be outside the European Union. We would also like to store and use your personal details for future marketing purposes (for example, sending you a brochure or details of new features, tours or special offers which we think may be of interest to you, including by email). All details you give us in connection with your booking (including those relating to any disability or medical condition or your religious beliefs) will be kept but we will use only names and contact details for marketing purposes (unless you have indicated that you do not wish us to do so. We respect your privacy and do not sell, rent, trade or give away any of your personal information for any purpose. Occasionally we hire other companies to provide services on our behalf, for example to mail information to you. We only provide those companies with the personal details relating to you which they require in order to deliver the service we ask them to deliver. They are prohibited from using that information for any other purpose. We will ensure that anyone to whom we pass your details for this reason agrees to treat it with the same level of protection we are obliged to provide. If you do not want us to do any or all of these things, please let us know as soon as possible. Except where expressly permitted by the Data Protection Act, we will only deal with the personal details you give us as set out above unless you agree otherwise. We have appropriate security measures in place to protect this information. You are generally entitled to ask us (by letter or e-mail) what details of yours are being held or processed, for what purpose and to whom they may be or have been disclosed. We will charge a fee to respond to such a request. We promise to respond to your request within 40 days of receiving your written request and fee. In certain limited circumstances we are entitled to refuse your request. If you believe that any of your personal details which we are processing are inaccurate or incorrect please contact us immediately. As our privacy statement may change due to developments in the law, we would encourage you to reread our privacy statement from time to time so that you are aware of any changes in how we gather and use personal information. Please note calls may be recorded for training and monitoring purposes.
23. OUR RESPONSIBILITY FOR YOUR TOUR
Bookings are accepted on the understanding that clients appreciate and accept the possible risks inherent in adventure travel and that they undertake the tours, treks or expeditions featured in our programme at their own volition.
(1) We promise to make sure that the tour arrangements we have agreed to make, perform or provide, as applicable, as part of our contract with you are made, performed or provided with reasonable skill and care. This means that, subject to these conditions and the other information which forms part of your contract with us, we will accept responsibility if, for example, you suffer death or personal injury or your contracted tour arrangements are not provided as promised or prove deficient as a result of the failure of ourselves, our employees, agents or suppliers to use reasonable skill and care in making, performing or providing, as applicable, your contracted tour arrangements. Please note, it is your responsibility to show that reasonable skill and care has not been used if you wish to make a claim against us. In addition, we will only be responsible for what our employees, agents and suppliers do or do not do if they were at the time acting within the course of their employment (for employees) or carrying out work we had asked them to do (for agents and suppliers).
(2) We will not be responsible for any injury, illness, death, loss (including loss possessions and loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following: –
the act(s) and/or omission(s) of the client(s) affected or any member(s) of their party or the act(s) and/or omission(s) of a third party not connected with the provision of your tour and which were unforeseeable or unavoidable or
‘force majeure’ as defined in clause 17 above
(3) Please note, we cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities which any supplier agrees to provide for you where the services or facilities are not advertised by us and we have not agreed to arrange them as part of our contract. Any optional excursions or activities booked during your holiday do not form part of our contract as these are all arranged for you directly by the suppliers concerned – please see clause 20 Optional activities above. In addition, regardless of any wording used by us on our website, in any advertising material or elsewhere, we only promise to use reasonable skill and care as set out above and we do not have any greater or different liability to you.
(4) The promises we make to you about the services we have agreed to provide or arrange as part of our contract – and the laws and regulations of the country in which your claim or complaint occurred – will be used as the basis for deciding whether the services in question had been properly provided. Please bear in mind that standards of, for example, safety, hygiene, and quality may vary throughout the destinations, services and transport your tour involves and may be lower than or different to those applicable in the UK. If the particular services which gave rise to the claim or complaint complied with the local laws and regulations applicable to those services at the time, the services will be treated as having been properly provided. This will be the case even if the services did not comply with the laws and regulations of the UK which would have applied had those services been provided in the UK. The exception to this is where the claim or complaint concerns the absence of a safety feature which might lead a reasonable holiday maker to refuse to take the tour in question.
(5) As set out in these conditions, we limit the maximum amount we may have to pay you for any claims you may make against us. We do not, however, limit or exclude our liability for death or personal injury caused by the negligence of ourselves or our employees (providing they were at the time acting within the course of their employment).
For all other claims which do not involve death or personal injury, if we are found liable to you on any basis, the maximum amount we will have to pay you is the price (excluding insurance premiums and amendment charges) paid by or on behalf of the person(s) affected in total unless a lower limitation applies to your claim under clause 23 (6) below. This maximum amount will only be payable where everything has gone wrong and you have not received any benefit at all from your tour.
(6) Where any claim or part of a claim (including those involving death or personal injury) concerns or is based on any travel arrangements (including the process of getting on and/or off the transport concerned) provided by any air, sea, rail or road carrier, the maximum amount of compensation we will have to pay you will be limited. The most we will have to pay you for that claim or that part of a claim if we are found liable to you on any basis is the most the carrier concerned would have to pay under the international convention or regulation which applies to the travel arrangements in question were that claim made against it (for example, the Warsaw Convention 1929 as amended or unamended and the Montreal Convention 1999 for international travel by air and/or for airlines with an operating licence granted by an EU country, the EC Regulation on Air Carrier Liability No 889/2002 for national and international travel by air, the Athens Convention 1974 for international travel by sea and COTIF, the Convention on International Travel by Rail. Please note: where a carrier would not be obliged to make any payment to you under the applicable international convention or regulation in respect of a claim or part of a claim, we similarly are not obliged to make a payment to you for that claim or part of the claim. When making any payment, we are entitled to deduct any money which you have received or are entitled to receive from the carrier or hotelier for the complaint or claim in question. Copies of the applicable international conventions and regulations are available from us on request.
(7) Please note, we cannot accept any liability for any damage, loss, expense or other sum(s) of any description (1) which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you or (2) which did not result from any breach of contract or other fault by ourselves or our employees or, where we are responsible for them, our suppliers. Additionally we cannot accept liability for any expenses or losses incurred by or relating to any business including self-employed loss of earnings.
(8) You must provide ourselves and our insurers with all assistance we may reasonably require. You must also tell us and the supplier concerned about your claim or complaint as set out in clause 11. If You have a Complaint. If asked to do so, you must transfer to us or our insurers any rights you have against the supplier or whoever else is responsible for your claim or complaint.
27. APPLICABLE LAW
The laws of the United Kingdom govern these Booking Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of the United Kingdom.
