These are the conditions of booking of Endless Summer Tours. The contract

between the parties is made on the terms outlined herein.

TOUR PRICES:

Are fixed once FULL pre-payment has been received and no adjustments to the tour price will be made thereafter. Amendments are accepted but within a month of departure we reserve the right to charge an amendment fee, or within 7 days of departure the appropriate cancellation fee may apply.

TOUR PRICES INCLUDE:

Accommodation:

As specified on the itinerary based on 2 people sharing a twin-bedded room. The use of hotels mentioned or implied in the tours is subject to accommodation being available. During the height of the local holiday season it may not always be possible to accommodate tour participants at nominated hotels. In this event our operator reserves the right to make use of equivalent alternative hotels. This will in no way affect the price of the tour.

Single Accommodation:

is at an additional cost.

Meals:

As specified on the tour itinerary.

Transport:

In air-conditioned luxury vehicles.

Tour Personnel:

The services of an experienced registered tour guide and approved driver will be used for the tour.

DATE OF DEPARTURE & COLLECTION TIMINGS - These are subject to change or cancellation, should unforeseen circumstances occur. Please reconfirm at time of booking.

SMOKING - Smoking is not permitted but all tours make frequent stops.

TOUR PRICES EXCLUDE:

Tips and Gratuities:

For the courier/driver, for hotel/restaurant employees and for anyone performing a personal service not specified on the itinerary. These are left to your own discretion.

Personal Items:

Bar bills and items such as cigarettes, telephone calls, laundry, curios, gifts and other extras are for your own account.

Air Fares:

Are EXCLUDED unless specifically stated as included in a particular itinerary or package.

Passport, visas, and immigration requirements: 

Participants are asked to ensure that all these are attended to as Endless Summer Tours and our operators accept no responsibility if such documentation is not in order.

HEALTH:

Malaria prophylaxis may need to be taken when visiting Northern Kwa Zulu Natal, Mozambique and the Kruger National Park. Consult your local doctor for advice for travel to South Africa. We accept no responsibility for your decision and that of your GP on whether or not to use malaria prophylaxis and/or the type used.

CANCELLATIONS:

Must be made in writing and will be effective on the date of receipt in our offices. Participants should ensure that they have appropriate insurance cover. We charge 50% of tour fee (your deposit fee), on all cancellations as a standard fee.

ALTERATIONS AND AMENDMENTS:

Endless Summer Tours reserve the right to change any route and/or arrangements should conditions necessitate this and to offer substitutions of equal value. Endless Summer Tours also reserve the right to decline to accept or retain any person as a member of any tour at any time, without giving any reasons therefore.

ACCIDENT OR LOSS:

We claim no liability for loss, damage, delay, inconvenience, or direct or consequential loss, however caused, unless due to our employees negligence, in which case our liability is limited (except for death or personal injury) to a maximum of the refund of the tour cost. We do not own or manage the train, ships, accommodation and restaurants used and we have no liability for loss or damage caused by the proprietors or operators thereof.

GENERAL CONDITIONS:

We may, at our discretion, require any person to withdraw from any tour if we deem his acts or conduct offensive or a nuisance to other passengers, and we shall have no further liability. We reserve the right to cancel any tours due to lack of demand and also to use vehicles as dictated by demand. No servant or agent of ours can vary our conditions and any such purported variation shall be of no effect unless it has been signed by one of our Directors.

ENDLESS SUMMER TOURS RESPONSIBILITY CLAUSES:

This company carries comprehensive passenger liability insurance, and details will be made available on request. The company and cooperating agents act only in the capacity of agents for the passengers in all matters and as such hold themselves free of responsibility for any delays, loss or damages from any cause whatsoever. All tours are arranged subject to the conditions imposed by the hotel, lodge, restaurant or any other individuals concerned and upon the express condition that the company and their servants/agents shall not be responsible for any and shall be exempt from all liability in respect of any loss, damage, injury, delay or inconvenience to any person/personal items/luggage and whether the same shall arise from or be occasioned by the negligence of the company, their agents or any other person directly or indirectly in the employment of the company or otherwise under  any circumstances whatsoever.

All tours, charters and hires, itineraries, travel arrangements, accommodation are subject to alteration or cancellation at any time without prior notice for any cause which in the absolute discretion of the company renders it desirable,reasonable or necessary to effect such alteration or cancellation and in particular but without prejudice to the generality of the foregoing in the event of the revision of arrangements or the imposition of conditions by restaurants, hotel or transport contractors. No liability of any kind shall fall upon the company in respect of any such alteration or cancellation.
